GENERAL TERMS AND CONDITIONS (BOARDING TERMS)

§1 Scope & General Provisions

  1. These General Terms and Conditions (GTC), henceforth referred to as “Boarding Terms”, apply to all business-related actions between PIRATE GmbH – Brabanter Str. 53, 50672 Cologne, Germany, Registered at the District Court of Cologne under HRB 106820 (henceforth “PIRATE”), and participants or contractors (henceforth “Participant”).
  2. These terms are valid for all PIRATE events, including but not limited to OMClub, PIRATE Night, PIRATE Dinner, and PIRATE Summit, as well as any other events hosted, organized, or supported by PIRATE.
  3. PIRATE shall be entitled to delegate its obligations under this Agreement to third parties or subsidiaries.
  4. Unless agreed otherwise, the primary language for all events and correspondence is English.
  5. Contracts are concluded solely on the basis of these Boarding Terms. Any conflicting terms from the Participant are explicitly excluded unless confirmed by PIRATE in writing.
  1. The Participant consents to PIRATE (and its subsidiaries) collecting, processing, and using personal data for the purpose of processing ticket purchases and event registration.
  2. Participant data (name, company, photograph, etc.) may be used to compile delegate lists. These lists may be shared with other attendees, speakers, or partners to facilitate networking. Participants who wish to be excluded from such lists should email info@pirate.global.
  3. PIRATE processes data in accordance with German and European privacy laws (GDPR). Detailed information can be found in our Privacy Policy.
  4. Requests for data removal can be sent to info@pirate.global or via mail to our office at Brabanter Str. 53, 50672 Cologne.

§3 Photography & Videography

  1. The Participant acknowledges and consents to being photographed and recorded during the events (including satellite events and dinners).
  2. PIRATE and authorized third parties may use these recordings for commercial, promotional, and documentation purposes across all media (online, print, TV, etc.) without further compensation.
  3. The Participant waives their right to their own image as per § 22 KunstUrhG for the duration of the event and its associated activities.

§4 Conclusion of Contract

  1. A contract is concluded when a Participant accepts a binding offer from PIRATE (via email, website, or ticketing provider) or completes a ticket purchase.
  2. Any subsequent changes to the scope of services require written consent from both parties.

§5 Payments, Refunds & Cancellations

  1. Cancellation Fees: A cancellation fee of 15% of the ticket price applies to all cancellations.
  2. Refund Deadlines:
    • Refunds are only possible within four weeks of the purchase date.
    • No refunds will be issued for cancellations made within six weeks of the event date.
  3. Cancellations must be submitted in writing (email or mail).
  4. Payment is due within 14 days of receiving the invoice, unless otherwise specified. In case of default, PIRATE reserves the right to charge late interest according to German law (§ 288 BGB).

§6 Delivery of Tickets

  1. Tickets are delivered electronically via email. Some ticket types may require additional attendee information before they are issued.
  2. The electronic ticket (or a printed copy) must be presented at the event for registration.

§7 Transportation & Accommodation

  1. PIRATE does not provide transport or cover travel/accommodation expenses unless explicitly agreed upon in writing.

§8 Liability

  1. PIRATE is liable only for damages caused by intent or gross negligence. This does not apply to damages resulting from injury to life, body, or health.
  2. PIRATE is not liable for losses or damages resulting from the substitution, alteration, cancellation, or postponement of an event due to “force majeure” (e.g., war, fire, strike, extreme weather, or other emergencies).
  3. While speakers and topics are confirmed at the time of publishing, PIRATE reserves the right to make necessary changes without liability.

§9 Compliance & Conduct

  1. Both parties agree to act in good faith, with mutual respect and loyalty.
  2. The reputation of PIRATE and its event brands (e.g., OMClub, PIRATE Night) is of high importance. Participants are expected to maintain professional conduct during and after their involvement.

§10 Non-Disclosure

  1. Both parties agree to keep confidential any non-public business information shared during the course of their cooperation. This includes corporate secrets, economic relations, and strategic data.

§11 Termination

  1. Either party may terminate the contract for cause (e.g., violation of cardinal duties or compliance agreements).

§12 Applicable Law & Jurisdiction

  1. German law applies.
  2. The place of jurisdiction is Cologne, Germany.

§13 Severability

  1. If any provision of these terms is found to be invalid, the remaining provisions remain in full force. The parties shall replace the invalid provision with one that best reflects the original intent.
